SCOPE

1.1 These terms and conditions and any other policies referred to in these terms and conditions (including any policies or documents to which a link is provided from these terms and conditions) (together "Terms") apply to all orders submitted by you for our website or Facebook channel. Please read the Terms carefully.

Please note that these Terms do not affect your statutory rights as a consumer. For more information on your statutory rights, contact your local Trading Standards Office or Citizens Advice Bureau, or the equivalent in your country (if any).

1.3 References to ‘We’ in the Customer Service Information refers to That Gadget UK as the context permits.

  1. ACCEPTANCE OF ORDERS

2.1 After submitting an order, That Gadget UK will send you an order confirmation email with your order number and details of the products you have ordered from That Gadget UK (the "Products") and details of the delivery services you have ordered from us. Please note that this email is an acknowledgement that That Gadget UK has received your order and is not an acceptance of your order. Acceptance of your order and the formation of (a) a contract of sale for the Products between That Gadget UK and you and (b) a contract for delivery services between us and you, will only take place after the order has been submitted and payment has been received by That Gadget UK.

2.2 Orders can only be placed on our Website or through our Facebook channel. That Gadget UK's Customer Service team act on behalf of us in respect of any queries about delivery. Please provide us with an email address, order number, name on order and we will follow the process outlined in Clause 2.1. If you have not provided That Gadget UK with the above, That Gadget UK reserves the right to follow an alternative process, which will be notified to you at the time. In either case, acceptance of your order and the formation of (a) a contract of sale of the products between That Gadget UK and you and (b) a contract for delivery services between us and you, will take place once an order has been submitted and the transaction has been settled with That Gadget UK.

  1. PRICES

3.1 All prices of our delivery services on the Website include any applicable VAT or sales tax payable.

3.2 We endeavour to ensure that all pricing information on Website is correct. Occasionally, however, an error may occur and our products or delivery services may be mispriced. If the correct price of our product or delivery services are lower than the price stated on the Website, we will charge you the lower amount and provide the delivery services. If the correct price of our product or delivery services is higher than the price stated on our Website, That Gadget UK will, at its discretion and on our behalf, contact you and ask you whether you wish to proceed with the order at the correct price or cancel your order and notify you of such cancellation. We will not be obliged to supply products or delivery services to you at an incorrect price.

3.3 We may vary the prices of our product or delivery services listed on a Website at any time without notice.

3.4 From time to time, That Gadget UK may offer a promotion in where delivery charges are reduced, in some cases to zero.

  1. PAYMENT TERMS

4.1 The cost for our products and delivery services will be itemised on the order confirmation issued by That Gadget UK.

4.2  That Gadget UK accepts payment by Visa Credit / Debit, Mastercard, American Express and PayPal. Payments made by PayPal eCheck will not be dispatched until payment has been cleared.

4.3 You confirm that the credit/debit card or payment method that is being used is yours and that all details you provide to us in respect thereof including, without limitation, name and address details are complete, correct and accurate. You further confirm that the credit/debit card or payment method is valid and the inputted payment details correct. All credit/debit cardholders and any payment account holders are subject to validation checks and authorisation by the card issuer or payment method provider. If the issuer of your card refuses to authorise payment, we will not accept your order and we will not be liable for any delay or non-delivery of your order.  We are not obliged to inform you of the reason for the refusal for security reasons.

4.4 We are not responsible for any additional charges or other amounts applied by your card issuer or bank or payment method provider as a result of our processing of your credit/debit card payment or other method of payment in accordance with your order.

4.5 If your credit/debit card or payment method is not denominated in the currency of your purchase indicated on the Website, the final price may be charged in the an alternative currency of your card or account.  Such final price is calculated and charged by your card issuer or bank or payment method provider. That Gadget UK will not be responsible for any cost, expense, charge or other liability incurred or suffered by you as a result of your card issuer or payment method provider charging you in a currency other than the currency set out on the Website.

  1. INVOICING

Where we elect, or are required by applicable law, to issue or make available an invoice, we reserve the right to issue or make available electronic invoices and you agree to such form of invoicing.

  1. DELIVERY, TITLE AND RISK

6.1 That Gadget UK provides delivery to you. When ordering, you will be offered our delivery service once you reach the delivery address details page. Orders will be sent to the delivery address that you have given on your order form. That Gadget UK cannot be held responsible if that delivery address is incorrect or incomplete. Please note that additional charges maybe implemented to resend an order if the address is incorrect or incomplete and the order has been dispatched from our warehouse. Please note that we do not deliver to PO boxes. Please note that there are restrictions on the locations to which we deliver products purchased from a Website. Details of the locations to which we deliver are available from us on request.

6.2 When you have selected your preferred delivery method from those offered for your selected shipping destination and provided your order has been accepted by us, your order shall be processed by Royal Mail.

That Gadget UK will endeavour to dispatch your order in accordance with the estimated delivery times set out on our shipping page. Orders received after any specified “cut off” or “last order” time or on a day which is not a working day (that is any day on which the banks are open for business in London which is not a Saturday or a Sunday) will be processed on the next working day. Estimated delivery times will be calculated from the date on which the order is processed.

If you have selected any of That Gadget UK’s delivery services, your sole remedy for any failure by That Gadget UK to dispatch your order in time for delivery within the relevant estimated delivery times for your shipping destination and selected delivery method shall be your right to cancel the relevant order and receive a full refund of any monies paid to That Gadget UK in respect of that order.

Please note that all delivery options available on our Website may not be available on any Application or the Website accessed using a mobile device.

6.3 Orders will only be dispatched once That Gadget UK receives payment in full for such products and delivery services.

6.4 We shall only be liable to you for any damage to the product that occurs between the time that your order has been dispatched from our warehouse and the time at which we deliver your order to you.

6.5 In the event that a product is subsequently imported into a country other than the country to which we delivered the Product, you shall be responsible for complying with all local import requirements, laws, regulations and rules and paying all import taxes and duties as may be applicable in respect thereof.

  1. LIABILITY

That Gadget UK will not be liable for any indirect, incidental or consequential losses arising from the use of our products.
 
8. ASSIGNMENT, SUBCONTRACTING

We reserve the right to transfer, assign, novate or sub-contract all or any of our rights and obligations under these Terms provided that your rights under these Terms are not adversely affected. You may not assign, sub-contract or otherwise transfer any of your rights or obligations under these Terms without our prior consent in writing.

  1. AMENDMENTS TO THESE TERMS

We reserve the right to make changes to these Terms at any time. You, and any contract between us, will be subject to the version of these Terms in force at the time you order Products and the delivery services in question from us.

  1. EVENTS BEYOND OUR REASONABLE CONTROL

We will not be held responsible for any delay or failure to perform or comply with our obligations under these Terms if the delay or failure arises from any cause, which is beyond our reasonable control.

  1. GOVERNING LAW AND JURISDICTION

These Terms and all transactions relating to Website are governed by English law and you, and we, hereby submit to the non-exclusive jurisdiction of the English courts.
